Terms of Service

YoTummy is an online listing platform that lets independent home cooks ("Sellers") publish information about food items they wish to sell, and lets visitors ("Buyers") discover and contact those Sellers. YoTummy is not a party to any sale, does not handle, prepare, store, deliver, or transport food, and does not process payments between Buyers and Sellers. All transactions, exchanges, and arrangements are made directly between Buyer and Seller.

YoTummy operates in jurisdictions whose cottage food (a.k.a. home-kitchen) laws permit individuals to prepare and sell certain foods from a private home without a commercial license. Each Seller is solely responsible for:

• Confirming they qualify under the cottage food law of their jurisdiction.
• Limiting their offerings to foods their jurisdiction allows.
• Holding any food handler permit, food licence, or registration their jurisdiction requires.
• Including any required disclosure on labels (for example, the "made in a home kitchen" notice).
• Complying with sales-volume caps, in-state-only restrictions, and any reporting obligations.

YoTummy makes no representation or warranty that any individual Seller is compliant. Buyers and Sellers transact at their own risk.

Food sold via YoTummy is prepared in home kitchens that are not subject to commercial inspection. By using YoTummy as a Buyer you acknowledge that you assume the inherent risks of consuming food prepared in such an environment, including without limitation foodborne illness, cross-contamination, and the presence of allergens. If you have a food allergy or dietary restriction, contact the Seller directly and confirm preparation conditions before purchasing.

YoTummy provides the platform "as is" and "as available." To the maximum extent permitted by law, YoTummy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and disclaims any implied warranty regarding the safety, quality, accuracy, or legality of any listing, food item, Seller, or Buyer.

To the maximum extent permitted by law, YoTummy, its owners, employees, and contractors shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or relating to (a) any food or item sold via the platform, (b) any interaction between Buyer and Seller, (c) any failure of the platform, or (d) any third-party service used by the platform (including SMS, email, mapping, hosting, or payment-processing providers).

Listing on YoTummy is free for Sellers offering up to twenty-five (25) items. Sellers offering more than twenty-five items may be charged a flat monthly subscription fee, currently $9.99/month. YoTummy does not charge a per-transaction fee or commission. Fees are non-refundable except where required by law. YoTummy may change subscription pricing on thirty (30) days' written notice to active subscribers.

You agree to provide accurate information when you create an account. You are responsible for keeping your credentials secure. You agree not to use the platform to publish content that is unlawful, fraudulent, defamatory, or that infringes another person's rights, and not to list items prohibited by your jurisdiction's cottage food law (for example, most meat or dairy products in jurisdictions that restrict them).

By posting a listing you grant YoTummy a non-exclusive, royalty-free license to display that listing on the platform and in related promotional material.

YoTummy may suspend or terminate any account at any time, with or without notice, for any reason including suspected violation of these Terms or applicable law. You may close your account at any time by contacting support.

Any dispute between Buyer and Seller is between those parties. YoTummy will not mediate, refund, or otherwise resolve transaction-level disputes. Any dispute between you and YoTummy will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, and resolved in the state or federal courts located in Dallas County, Texas.

YoTummy may update these Terms from time to time. Material changes will be announced on the platform. Continued use after the effective date of an update constitutes acceptance of the updated Terms.
